1. The Service
Tap Family is a communication and workflow platform designed for senior care communities and related care environments. The Service may include messaging, resident updates, family communication, staff communication, tasks, announcements, feed activity, notification tools, audit logs, administrative dashboards, and related features.
Tap Family is not a healthcare provider, medical practice, care facility, emergency service, nurse call system, medical device, electronic medical record, remote patient monitoring system, clinical decision support tool, or substitute for professional care, clinical judgment, emergency response, or direct communication with care staff.
2. Eligibility
You may use the Service only if you:
- are at least 18 years old; - have been invited, authorized, or approved by a participating facility, organization, or Tap Family; - can form a legally binding agreement; - are not prohibited from using the Service under applicable law; - comply with these Terms and all applicable policies.
Accounts are limited to authorized Users. Tap Family may refuse registration, suspend access, revoke invitations, or require additional verification at any time.
3. Facility-Controlled Access
Many accounts are created, invited, managed, approved, or removed by a participating facility, employer, administrator, or care organization ("Facility"). A Facility may control:
- who may access resident, family, staff, or operational information; - User roles and permissions; - resident assignments; - contact lists; - communication workflows; - content retention and deletion; - exports; - integrations; - staff access; - family access; - administrative settings.
Tap Family is not responsible for a Facility's decisions regarding authorization, access, staffing, resident information, family contacts, employment status, care decisions, content accuracy, or use of the Service.
If you believe your access is incorrect, excessive, insufficient, unauthorized, or outdated, contact the Facility administrator and notify Tap Family if appropriate.
4. Account Responsibilities
You are responsible for:
- keeping your login credentials confidential; - using strong passwords and secure devices; - enabling available security features where appropriate; - maintaining accurate account information; - all activity under your account; - promptly notifying Tap Family and your Facility of suspected unauthorized access, credential compromise, or security incidents; - logging out of shared or public devices; - complying with Facility policies and applicable law.
You may not share, sell, transfer, lend, or sublicense your account. You may not allow another person to use your credentials.
Tap Family may treat activity under your account as authorized unless we have received notice and had a reasonable opportunity to act.
5. Acceptable Use
You agree not to use the Service to:
- violate any law, regulation, court order, contract, privacy right, intellectual property right, or other right; - access, view, use, disclose, export, copy, or share information you are not authorized to access; - send abusive, threatening, harassing, discriminatory, defamatory, obscene, deceptive, fraudulent, or unlawful content; - impersonate any person or entity; - misrepresent your relationship to a Resident, Facility, employer, or User; - upload malware, spyware, ransomware, viruses, or harmful code; - interfere with, overload, disrupt, scan, probe, or attack the Service or related systems; - attempt to bypass security, authentication, authorization, rate limits, access controls, or audit logs; - scrape, harvest, crawl, index, or bulk extract data without written permission; - reverse engineer, decompile, disassemble, copy, modify, or create derivative works of the Service except as permitted by law; - use the Service to build or train a competing product or service; - use the Service for advertising, solicitation, spam, political campaigning, fundraising, or unrelated commercial messages unless expressly authorized by Tap Family and the Facility; - submit unnecessary sensitive information; - use the Service for emergency, urgent, or life-threatening communications; - use another User's account; - encourage or assist anyone else in doing any of the above.
Tap Family may investigate suspected violations and may suspend, restrict, or terminate access as described in these Terms.
6. Communication Guidelines
The Service is intended for respectful, care-related, operational, and family communication. Users should communicate professionally, accurately, and lawfully.
Staff response times, Facility workflows, resident updates, task completion, and communication standards are determined by the Facility, not Tap Family. Tap Family does not guarantee that any message will be read, acknowledged, escalated, answered, or acted upon within any specific timeframe.
For emergencies, call 911 or the appropriate emergency number. For urgent resident, medical, staffing, safety, medication, transfer, fall, elopement, abuse, neglect, or clinical concerns, contact the Facility directly using its emergency or urgent procedures.
7. No Medical, Legal, or Professional Advice
Content available through the Service may include messages, resident updates, task notes, announcements, and other information submitted by Users or Facilities. Tap Family does not provide medical, nursing, caregiving, legal, financial, insurance, social work, or professional advice.
You should not rely on the Service as the sole source of truth for medical decisions, care decisions, legal decisions, emergency response, staffing decisions, or regulatory compliance. Facilities and licensed professionals remain responsible for care, documentation, clinical decisions, resident safety, supervision, and compliance.
8. HIPAA and Protected Health Information
Where applicable, Tap Family may act as a business associate to a covered entity or another business associate under HIPAA. In those circumstances, Tap Family's obligations regarding protected health information ("PHI") are governed by HIPAA and the applicable Business Associate Agreement.
You agree not to submit, access, disclose, export, or use PHI through the Service except as authorized by the Facility, permitted by your role, allowed by applicable law, and consistent with applicable agreements.
Facilities are responsible for:
- determining whether they are covered entities or business associates; - obtaining required consents, authorizations, notices, and permissions; - configuring appropriate access controls; - training staff and Users; - maintaining required records; - implementing Facility policies and safeguards; - determining what information may be shared with family contacts or other Users; - complying with HIPAA and other healthcare, privacy, employment, and recordkeeping laws.
Tap Family is not responsible for unauthorized disclosure caused by Facility misconfiguration, incorrect permissions, User conduct, shared credentials, shared devices, screenshots, exports, downloaded files, communications outside the Service, or Facility failure to maintain appropriate policies and safeguards.
9. User Content and Facility Content
You retain whatever rights you have in content you submit to the Service. By submitting, uploading, sending, posting, storing, or creating content through the Service, you grant Tap Family a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, display, perform, distribute, modify, format, translate, create technical derivatives of, and otherwise use that content as necessary to provide, secure, support, maintain, improve, and administer the Service and comply with law.
This license does not give Tap Family ownership of your content. It allows Tap Family to operate the Service.
You represent and warrant that:
- you have all rights, permissions, consents, and authority needed to submit the content; - the content is accurate to the best of your knowledge where accuracy is required; - the content does not violate law, privacy rights, intellectual property rights, Facility policy, or these Terms; - you will not submit content you are not authorized to share.
Tap Family may remove, restrict, preserve, or disclose content as reasonably necessary to operate the Service, comply with law, enforce these Terms, protect safety, respond to support requests, maintain audit logs, or address suspected violations.
10. Intellectual Property
The Service, including software, source code, object code, interfaces, designs, graphics, logos, trademarks, service marks, workflows, databases, documentation, content, features, and functionality, is owned by Tap Family or its licensors and is protected by intellectual property and other laws.
Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or exploit any part of the Service except as expressly permitted by Tap Family in writing or by applicable law.
The names "Tap Family" and "TapFamily.com," and related logos and marks, may not be used without our prior written permission.
11. Feedback
If you provide ideas, suggestions, comments, improvements, bug reports, feature requests, or other feedback, you grant Tap Family a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable right to use, copy, modify, commercialize, and otherwise exploit that feedback without restriction or compensation to you.
12. Third-Party Services
The Service may link to, integrate with, rely on, or allow access through third-party services, including app stores, cloud providers, notification providers, email providers, SMS providers, analytics tools, payment processors, identity providers, Facility systems, or other integrations.
Tap Family does not control and is not responsible for third-party services. Your use of third-party services may be governed by separate terms and privacy policies. Tap Family is not liable for third-party acts, omissions, outages, data handling, security incidents, pricing, changes, or failures.
13. Fees, Billing, and Subscriptions
Certain parts of the Service may be offered under a subscription, facility agreement, order form, pilot, trial, or other paid arrangement. Fees, payment terms, taxes, renewals, cancellations, and refund terms are governed by the applicable written agreement, checkout terms, invoice, or order form.
Unless otherwise stated in a signed written agreement, fees are non-refundable to the maximum extent permitted by law.
Tap Family may suspend or terminate access for nonpayment, payment disputes, chargebacks, expired payment methods, or breach of payment terms.
14. Service Availability and Changes
We may modify, update, suspend, discontinue, replace, limit, or remove any part of the Service at any time. We may also impose limits on storage, accounts, messages, files, integrations, notifications, usage, or features.
We strive to provide reliable service, but we do not guarantee uninterrupted, timely, secure, error-free, or loss-free operation. The Service may be unavailable due to maintenance, updates, outages, cyberattacks, network issues, third-party failures, emergencies, force majeure events, or other causes.
Tap Family is not liable for downtime, delays, message delivery failures, notification failures, data loss, or Service interruptions except to the extent prohibited by law or expressly provided in a signed written agreement.
15. Beta Features
We may offer beta, pilot, preview, experimental, or early-access features. Such features may be incomplete, changed, withdrawn, unreliable, or subject to additional terms. You use beta features at your own risk.
16. Privacy
Your use of the Service is subject to our Privacy Policy. By using the Service, you acknowledge our collection, use, disclosure, and processing of information as described in the Privacy Policy and applicable agreements.
17. Suspension and Termination
Tap Family may suspend, restrict, or terminate your access to the Service at any time if we believe that:
- you violated these Terms; - your account is unauthorized, inactive, compromised, or risky; - your access is no longer authorized by a Facility; - continued access may create legal, privacy, security, safety, operational, or reputational risk; - payment is overdue; - required by law, court order, government request, or Facility instruction; - the Service is discontinued.
You may stop using the Service at any time. Account deletion or access removal may be subject to Facility control, audit retention, legal obligations, backups, and applicable agreements.
Sections that by their nature should survive termination will survive, including intellectual property, feedback, disclaimers, limitations of liability, indemnification, dispute terms, governing law, payment obligations, confidentiality, audit, and privacy-related provisions.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TAP FAMILY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, AND ERROR-FREE OPERATION.
TAP FAMILY DOES NOT WARRANT THAT:
- THE SERVICE WILL MEET YOUR REQUIREMENTS; - THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE; - MESSAGES, NOTIFICATIONS, TASKS, OR UPDATES WILL BE DELIVERED, READ, ESCALATED, OR ACTED UPON; - CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; - DATA WILL NEVER BE LOST, CORRUPTED, ACCESSED WITHOUT AUTHORIZATION, OR DISCLOSED; - DEFECTS WILL BE CORRECTED; - THE SERVICE WILL SATISFY ANY LEGAL, REGULATORY, LICENSING, CARE, DOCUMENTATION, OR ACCREDITATION REQUIREMENT.
Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAP FAMILY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, SUBSTITUTE SERVICES, CARE DELAYS, COMMUNICATION FAILURES, OR PERSONAL INJURY CLAIMS ARISING FROM USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAP FAMILY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT PAID TO TAP FAMILY FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR - ONE HUNDRED U.S. DOLLARS ($100).
The limitations above apply to all claims, whether based on contract, tort, negligence, strict liability, statute, warranty, or any other legal theory, except where prohibited by law.
20. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Tap Family and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, service providers, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use or misuse of the Service; - your content; - your violation of these Terms; - your violation of law or third-party rights; - your unauthorized access to or disclosure of information; - your Facility configuration, permissions, invitations, access decisions, care decisions, or operational decisions; - your negligence, willful misconduct, fraud, or security failures; - any dispute between you and another User, Resident, family member, staff member, Facility, employer, or third party.
Tap Family reserves the right to control the defense of any matter subject to indemnification, and you agree to cooperate with our defense.
21. Confidentiality
You may receive access to non-public information through the Service, including resident information, family information, staff information, Facility operations, business information, product features, security information, or Tap Family information. You agree to keep such information confidential and use it only for authorized purposes.
This section does not limit disclosures required by law, but you must provide notice to Tap Family and the applicable Facility where legally permitted before making such disclosure.
22. Export and Legal Compliance
You may use the Service only in compliance with applicable laws, including privacy, healthcare, employment, data protection, export control, sanctions, anti-corruption, and communications laws. You may not use the Service if you are located in or ordinarily resident in a country or region subject to applicable U.S. sanctions, or if you are on a restricted party list.
23. Disputes Between Users and Facilities
Tap Family is not responsible for disputes between or among Users, Residents, family members, staff, employers, Facilities, care providers, guardians, representatives, or third parties. This includes disputes about care quality, staff conduct, resident status, family access, medical information, response time, employment, billing by a Facility, guardianship, authorization, or Facility policies.
You release Tap Family from claims arising from such disputes to the maximum extent permitted by law.
24. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except that the Federal Arbitration Act governs the arbitration agreement below.
25. Arbitration Agreement and Class Action Waiver
Please read this section carefully. It affects your rights.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, your account, or your relationship with Tap Family will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
The arbitration will be administered by the American Arbitration Association under its applicable rules, unless the parties agree otherwise. The arbitration will take place in Pinellas County, Florida, unless the parties agree to remote proceedings or another location.
You and Tap Family agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding unless both parties agree in writing.
Either party may seek injunctive or equitable relief in court to protect intellectual property, confidential information, security, privacy, or unauthorized access to the Service.
If this arbitration agreement is found unenforceable as to a particular claim or request for relief, that claim or request may proceed in court, but only after arbitration of all arbitrable claims is completed, unless a court determines otherwise.
26. Venue
For any dispute not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Pinellas County, Florida, or the nearest available federal court with jurisdiction, and you waive any objection to personal jurisdiction, venue, or inconvenient forum.
27. Time Limit to Bring Claims
To the maximum extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one year after the claim arose. Otherwise, the claim is permanently barred.
28. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a revised "Last updated" date. If we make material changes, we may provide notice through the Service, by email, through an administrator, or by other reasonable means.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law. If you do not agree to the updated Terms, you must stop using the Service.
29. Assignment
You may not assign or transfer these Terms or your account without Tap Family's prior written consent. Tap Family may assign or transfer these Terms without restriction, including in connection with a merger, acquisition, reorganization, financing, sale of assets, or by operation of law.
30. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
31. No Waiver
Tap Family's failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. Any waiver must be in writing and signed by Tap Family.
32. Entire Agreement
These Terms, the Privacy Policy, and any applicable signed written agreement with Tap Family constitute the entire agreement between you and Tap Family regarding the Service and supersede prior or contemporaneous understandings on that subject.

34. Important Notice
These Terms are a general online service agreement. Facilities may need separate agreements, including a subscription agreement, Business Associate Agreement, Data Processing Addendum, service-level terms, implementation terms, and Facility-specific policies.
